The firm Balms Abogados Marbella will initiate claims against the Volkswagen group in Malaga for the manipulation of the software that modifies the emissions of emitted gases

Balms Abogados Marbella has already begun to represent a group of consumers affected by the manipulation of emissions, in order to initiate different types of claims against the Volkswagen Group.

It is clear that the Volkswagen Group pollutant emissions scandal has led to different national and international reactions. In particular, many users and shareholders of the Volkswagen Group throughout the province of Malaga have contacted the firm Balms Abogados Marbella to receive full advice aimed at submitting legal claims against the Volkswagen Group.

The main issues raised by the purchasers of vehicles of the Volkswagen Group are:

  • if your car is among those affected;
  • if you must access a repair offered by the Volkswagen Group; and,
  • if you are entitled to claim any compensation.

As for the affected shareholders of the Volkswagen Group, they have suffered a fall in their shares, causing them enormous damage due to the large economic losses.

At the moment, the models of the affected Volkswagen Group vehicles are of the brands: Volkswagen, Volkswagen Commercial Vehicles, Skoda, Audi and Seat, although others are expected to be affected.

Each of the aforementioned brands incorporated in different vehicle models the TYPE EA 189 diesel engine with 1.6 TDI and 2.0 TDI displacement and the 1.2 litre diesel engines, which had a software system capable of detecting if the car was being subjected to a Homologation test, in which case it reduced polluting emissions, and in particular, Nitrogen Oxide (“NOx”) and showed a lower emission level than the actual one.

Although the first consequence after the knowledge of the scandal, is a real loss of the value of the affected vehicles, the firm Balms Abogados Marbella is studying with experts in the matter in Malaga the problem that involves the repair of the vehicles.

Once the engine software is corrected according to the established regulations on pollutant emissions, it is raised by the experts what the consequences could be on the vehicle, and there has been talking among others of:

  • loss of power
  • loss of vehicle value
  • higher fuel costs
  • pay more in parking meters that depend on emissions
  • higher fuel cost
  • extraordinary reviews of the ITV

According to several press publications, the German Federal Transport Authority will soon present the solutions for the 1.2-litre diesel engine. On the other hand, the Volkswagen Group is constantly working to offer a solution to the TYPE EA 189 diesel engines with 1.6 TDI and 2.0 TDI displacement. The main objective of the Volkswagen Group is to offer a quick repair of the vehicle thus meeting the emission limits without affecting the engine performance or fuel consumption.

In any case, the claims will begin in the next dates, in addition to organising those affected through a platform that allows them to be informed and coordinated at all times.
